Please read this carefully. By signing it or ticking the box, you give up legal rights, including the right to sue for injuries caused by ordinary negligence.
1. Parties and activities
"WITM" means Zoe Ophelia Holdings LLC, doing business as Weddings in the Methow, and its members, managers, employees, contractors, on-site hosts and agents. "Participant" means you, the person signing. The "Activities" are any part of a bachelor, bachelorette or combined party weekend that WITM plans, books, coordinates or hosts. They include, for example: river floats and other water activities; mountain biking and cycling; hiking, horseback riding and other outdoor recreation; wine, cider, beer and spirits tastings and other alcohol service; spa services; group lodging; meals and private chefs; fire pits and stargazing; and the transportation between them.
2. Eligibility
You must be at least 18 years old to take part in the Activities or sign this waiver. Anyone under 18 may not take part.
3. Assumption of risk
You understand that the Activities carry inherent risks that cannot be eliminated. These include: drowning, cold water and swift or changing currents, submerged objects and capsizing; falls, collisions and crashes; uneven or remote terrain; animals and insects; heat, cold, sun, lightning, wildfire and wildfire smoke, and other weather; limited cell service and distance from medical care; vehicle travel on mountain roads; food allergies and foodborne illness; the effects of alcohol; and the conduct of other participants and the public. These risks can result in property damage, illness, serious injury, paralysis or death. You voluntarily choose to take part and assume all of these risks, known and unknown. You confirm that you are physically fit to take part, that you will follow all safety instructions and equipment rules (including life jackets and helmets), and that you may decline any activity at any time.
4. Release and waiver
To the fullest extent permitted by Washington law, you release, waive and discharge WITM from any and all claims, demands, losses and liability arising out of or related to the Activities. This includes claims caused by the ordinary negligence of WITM. It does not cover gross negligence, or willful or wanton misconduct. This release binds you, your heirs, executors, administrators and assigns.
5. Indemnity
You agree to indemnify, defend and hold WITM harmless from claims, damages, costs and attorney fees arising out of your conduct during the Activities. This includes your alcohol consumption, any damage to lodging or equipment, and any injury you cause to others.
6. Third-party vendors and outfitters
Outfitters, guides, rental shops, tasting rooms, wineries, lodging owners, transportation providers, chefs, spas and other vendors are independent businesses. They are not employees or agents of WITM. WITM recommends, books or coordinates them as a convenience. WITM does not operate, control, supervise or inspect their equipment, premises, staff or services, and is not responsible for their acts or omissions. Vendors may require their own waivers, age limits, skill checks and rules. You agree to sign and follow them, and your rights against a vendor are governed by that vendor's terms.
7. Alcohol and the 21+ rule
Alcohol will be served or consumed only by participants who are 21 or older and can show valid photo ID. Never give alcohol to anyone under 21. You are solely responsible for your own consumption. Do not drink and drive, or drink before or during water, biking or other physical activities. WITM, its hosts and vendors may refuse service, end an activity or send home any participant who appears intoxicated, unsafe or disruptive, without a refund. Alcohol service at tastings and venues is provided by licensed third parties under their own licenses.
8. Medical consent
You confirm that you have told WITM, in writing and in advance, about any medical condition, allergy or medication that could affect your safety. If you are injured or ill and cannot consent yourself, you authorize WITM and its hosts to seek emergency medical treatment and transportation for you, including calling 911. You agree to pay all costs of that care. WITM's hosts are not medical professionals.
9. Conduct and property
You agree to follow the rules of lodging, venues and vendors (including quiet hours, occupancy limits and fire restrictions) and to pay for any damage you cause. WITM is not responsible for lost, stolen or damaged personal property.
10. Photo and media consent
You allow WITM to photograph and record the Activities and to use images in which you appear, without payment, on WITM's website, social media and marketing. If you don't want your image used for marketing, email [email protected] before the event, and WITM will honor that request for marketing use.
11. Governing law, venue and severability
This waiver is governed by the laws of the State of Washington. Any dispute will be brought only in the state or federal courts serving Okanogan County, Washington. This waiver is intended to be as broad and inclusive as Washington law permits. If any part of it is found invalid or unenforceable, that part will be limited or severed, and the rest stays in full force.
12. Acknowledgment
I have read this waiver, I understand that I am giving up substantial rights, and I sign it (or tick the box) voluntarily. I confirm that I am at least 18 years old.
