These Terms of Use ("Terms") are an agreement between you and Zoe Ophelia Holdings LLC, doing business as Weddings in the Methow ("WITM", "we", "us"). They cover your use of weddingsinthemethow.com, portal.weddingsinthemethow.com, the gift registry, the Wedding Shop and Shop Local (the "Services"). By creating an account, applying, requesting access, joining a registry or otherwise using the Services, you agree to these Terms and our Privacy Policy.
Accounts
Portal accounts are invite-only, except registry guest logins, which require the couple's guest code. Keep your password private, give accurate information, and tell us at once if you think your account has been misused. You must be at least 18 to create an account. We may suspend or close accounts that break these Terms.
Planning services, deposits and separate agreements
Wedding planning, coordination, catering, and bachelor/bachelorette planning are governed by the separate written agreement or terms you accept for those services. These include the date-hold deposit terms shown at checkout. Where those terms conflict with these Terms, those terms control. Prices and availability shown on the site are estimates until confirmed in writing.
Vendor partners and local makers
Vendor partners and outfitters are independent businesses. They are not WITM employees or agents, and each is responsible for its own services, licenses and insurance. Shop Local makers are also bound by the Shop Local maker agreement.
Gift registry and Wedding Shop
Registries are created by couples. WITM doesn't guarantee that a gift claim prevents duplicate purchases, or that the price or availability of any item is accurate. Items bought from Amazon, Target or other retailers are sold by those retailers under their own terms. Shipping, returns and warranties are between you and the retailer. Methow Made / Shop Local items are sold by WITM and made by independent local makers, and are processed through Stripe.
Affiliate disclosure
As an Amazon Associate, Weddings in the Methow earns from qualifying purchases. Some links are affiliate links (Amazon, and Target through Impact), and we may earn a commission when you buy through them at no extra cost to you. Amazon and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates.
Date-hold deposits
Online date-hold deposits are governed by the Date-Hold Deposit Agreement shown on the booking page before checkout. Planning services are governed by the Wedding Planning Services Agreement you sign in your portal.
Bachelor and bachelorette activities
Participants in activities we plan must accept our participant waiver & release.
Payments
Payments are processed by Stripe and are subject to Stripe's terms. You authorize us to charge the payment method you provide for the amounts you approve.
Notifications
If you turn on push notifications, we'll send account and planning alerts. You can turn them off at any time.
Acceptable use
Don't misuse the Services. That means: don't access other people's accounts or data, upload unlawful or infringing content, send spam, scrape the Services, or interfere with security. Content you upload (such as photos, product listings and notes) stays yours. You give WITM a license to host and display it to run and promote the Services.
Disclaimers and limitation of liability
The Services and site content (including venue, travel, weather and planning information) are provided "as is" for general information. To the fullest extent the law allows, WITM is not liable for indirect, incidental or consequential damages. WITM is also not liable for the acts or omissions of independent vendors, outfitters, retailers or makers. WITM's total liability arising from use of the Services (as opposed to a separate service agreement) is limited to the greater of $100 or the amount you paid WITM in the 12 months before the claim.
Electronic communications and signatures
You agree to receive notices, agreements and disclosures electronically. Ticking a box, typing your name, or clicking to accept is your electronic signature, under Washington's Uniform Electronic Transactions Act (RCW 1.80).
Our intellectual property
The site, portal, text, design, logo and the "Weddings in the Methow" and "Methow Made" names belong to WITM or its licensors. You may not copy, modify or reuse them except to use the Services for your own wedding. Third-party photos are used under the licenses listed on our Photo credits page.
Copyright complaints
If you believe content on the Services infringes your copyright, email [email protected]. Please identify the work, the material you believe infringes it and where it appears, give your contact details, and include a statement of good-faith belief. We will review the complaint and remove material where appropriate.
Indemnity
You agree to indemnify and hold WITM harmless from claims, losses and costs (including reasonable attorney fees) arising from your content, your misuse of the Services, or your breach of these Terms.
Suspension and termination
You may stop using the Services or ask us to close your account at any time. We may suspend or end access if you break these Terms, if needed for security, or if we discontinue a feature. The sections that by their nature should survive termination will survive, including the sections on intellectual property, disclaimers, limitation of liability, indemnity and governing law.
Informal dispute resolution
Before filing a claim, you agree to contact us at [email protected] and try in good faith to resolve the dispute for 30 days.
General
These Terms, the Privacy Policy and any service-specific agreement are the entire agreement about the Services. If any part is unenforceable, it will be limited or severed and the rest stays in effect. Our failure to enforce a term is not a waiver. You may not assign these Terms. We may assign them to an affiliate or successor. Neither party is liable for delays caused by events beyond its reasonable control.
Governing law
These Terms are governed by the laws of the State of Washington. Disputes will be resolved in the state or federal courts serving Okanogan County, Washington, unless a separate agreement says otherwise.
Changes
We may update these Terms. If we do, we'll change the version and date above, and continued use means you accept the updated Terms. Where the changes are material, we may ask you to agree again.
